STATEMENT BY EXECUTIVE MAYOR OF STELLENBOSCH MUNICIPALITY – GESIE VAN DEVENTER
Outdoor dining is a wonderful part of Stellenbosch’s attraction for visitors and it is part of our very special culinary tradition, which we cherish. Unfortunately, I have received various complaints regarding the contravention of the Municipality’s Policy and Permit conditions for outdoor dining.
Although there is no law against trading on sidewalks and public spaces, it is strictly regulated by the Policy on Outdoor Dining, Trade and use of Public Places for Commercial Ventures and Display. The policy stipulates how and under what circumstances sidewalks and road reserves can be used by cafes, restaurants and traders. It stipulates that the use of the sidewalk or reserve must not hamper safe and easy access for users and that all businesses must have permission from the Municipality to use the specified space. Business must enter into written agreements with the Municipality to use any sidewalks or road reserves.
Following a number of complaints about limited or blocked access of sidewalks, I decided to personally inspect the central area and acquaint myself with the situation. I indeed found that the complaints are legitimate. During my site inspection I found that some businesses are making use of the road reserve for outdoor dining purposes. This definitely does not comply with the Policy or specific permit condition. It hampers the free flow of pedestrian traffic and limits or prevents the access of people with disabilities. In general, I found that businesses did not comply with the prescribed 1,4m clearance, encroaching onto the areas meant for pedestrians with tables, chairs or other objects including screens and advertising signs.
I have therefore sent out letters to businesses in the area to request their cooperation in complying with the minimum requirements/specific permit conditions with immediate effect. If businesses do not comply, the Municipality will unfortunately have no choice but to rescind the permits of the guilty parties. Letters were delivered by hand and every business signed the delivery register to acknowledge receipt thereof.
I urge all businesses to cooperate in this regard and to help us make Stellenbosch a place that all residents and tourists can enjoy.
