DA calls for Parliamentary Inquiry into Mchunu allegations

The Democratic Alliance (DA) calls for a joint parliamentary inquiry between the Portfolio Committees of Police and Justice to investigate allegations of corruption and political interference in the criminal justice system.

The DA will request the chairpersons on these portfolio committees to set up such a joint enquiry without delay.

This call follows the recent damning allegations made by KwaZulu- Natal’s Provincial Commissioner, Lieutenant General Nhlanhla Mkhwanazi which directly implicates the Minister of Police in serious misconduct, and other actors in the criminal justice system.

In light of the urgency of this matter, this proposal is the best alternative to an ad hoc committee, which requires the approval of the House, since the issue cuts across different portfolios.

These brazen allegations highlight the critical need to restore the integrity of the criminal justice system. It is vital that institutions are able to investigate and prosecute crime without fear, favour or political interference. This is the backbone of a functional criminal justice system. Yet, these allegations point to a disturbing collapse in justice where accountability is compromised and applied only to a select few.

The DA believes that Parliament can no longer rely on these institutions to police themselves. A formal parliamentary inquiry is essential to uncover the truth, establish accountability and restore integrity to the Criminal Justice System.

The joint inquiry,  in line with Section 55 and 56 of the Constitution, shoud, among other things:

  • Investigate criminal infiltration in SAPS leadership and operations;
  • Assess vetting, lifestyle and skills audits for senior appointments;
  • Evaluate the effectiveness and integrity of Crime Intelligence;
  • Investigate failures in accountability and prosecutions;
  • Assess the impact of SAPS failures on the justice system;
  • Examine operational weaknesses enabling corruption;
  • Recommend legislative and structural reforms and;
  • Develop a roadmap for restoring integrity and public trust in SAPS

The inquiry will be guided by the principles of transparency, inclusivity, and accountability.  The people of South Africa deserve a police service and justice system that is both accountable and free from political interference. The DA is committed to ensure that both are delivered and that those who have undermined the integrity of our law enforcement institutions are held accountable.
